That should an UST inspector find fuel in a spill containment manhole you will be cited for two violations:

  • Failure to provide spill containment.
  • Failure to investigate a suspected release.

The first violation is easy enough to fix.  You simply clean all fluid and trash from the spill containment manhole.  The second violation is altogether a different matter.  First you must fill out and file an UST-17A form notifying the State of the suspected release.  Then you must conduct an hydrostatic test of the spill containment manhole.  If all is well with the test you file, within 7 days of the UST-17A, the UST-17B form, notifying the State of the results of your investigation.  If the spill fails the test then you must conduct a “site check” ie soil/water samples around the leaking spill.  Isn’t it easier just to maintain your equipment on a regular basis?
